The Trump administration has filed an appeal urging the Supreme Court to allow it to terminate Temporary Protected Status (TPS) for approximately 350,000 Haitian migrants residing in the United States. This move marks the latest effort to roll back Biden-era immigration protections as part of the administration’s enforcement agenda.

Legal Battle Over TPS Termination Intensifies

U.S. Solicitor General D. John Sauer requested the Supreme Court to intervene and overturn a lower court’s injunction that blocked the immediate revocation of TPS for Haitians. The U.S. Court of Appeals for the D.C. Circuit previously blocked the administration’s attempt, citing significant documented harms to the affected migrants. Sauer’s filing emphasized the need for the Supreme Court to resolve the broader legal questions surrounding TPS termination, warning that without resolution, courts nationwide will continue issuing conflicting rulings.

Background on Haitian TPS and Judicial Responses

TPS was first granted to Haitians in 2010 after a devastating earthquake that killed over 200,000 people and displaced 1.5 million. The protection was extended multiple times, including in 2021 following the assassination of Haiti’s president, Jovenel Moïse. In November, DHS Secretary Kristi Noem announced the planned end of TPS for Haitians, prompting legal challenges. In January, U.S. District Judge Ana Reyes blocked the termination, calling the effort “arbitrary and capricious” and citing the continued dangers in Haiti. Reyes also criticized the administration for not providing concrete evidence of harm from maintaining TPS.

The administration has framed the longstanding extensions of TPS as unsustainable and has sought to end most TPS programs established under previous Democratic administrations. Legal challenges remain pending, including another Supreme Court request to end TPS protections for Syrian migrants.
