Attorney John Lauro, who defended former President Donald Trump in special counsel Jack Smith’s 2020 election investigation, received backing from conservative legal figures following his remarks praising the Trump-era Department of Justice (DOJ) at a recent American Bar Association (ABA) conference. Lauro’s comments sparked pushback from attendees, highlighting ongoing tensions between the Trump administration and the ABA.
Lauro Criticizes ABA and DOJ Under Biden at San Diego Conference
During a panel at an ABA conference in San Diego, Lauro stated the DOJ was “in a better place” under Trump, provoking strong reactions from other panelists. He condemned the ABA and “other elite legal organizations” for not denouncing what he called “political sham trials,” specifically referencing the Biden administration’s efforts to prosecute Trump within an unusually short timeline.
Lauro described the event as a “highly triggered environment” and said he represented a political figure who was “probably more abused by the criminal justice system in America than any other political figure ever.” He argued contemporary proceedings should be viewed through that perspective.
Conservative Legal Figures Back Lauro, Criticize ABA’s Influence
Conservative DOJ officials and legal commentators rallied around Lauro’s position. Civil Rights Division head Harmeet Dhillon called the ABA “trash” and praised avoiding membership. Associate Deputy Attorney General Diego Pestana labeled the ABA “a disgrace” for sidelining Lauro after he voiced dissenting views.
Iowa Solicitor General Eric Wessan criticized the ABA as “a hyperpartisan faction” that should have no role in law school accreditation or judicial appointments. Former DOJ official Jeff Clark called Lauro “a bold man of principle.”
ABA Faces Pushback Over Political and Social Positions
Republicans have long argued that the ABA promotes partisan, liberal viewpoints, pointing to its support for LGBTQ+ rights, abortion access, gun control, and diversity initiatives. The ABA has also publicly condemned actions taken by the Trump administration, with its president citing “wide-scale affronts to the rule of law.”
The ABA traditionally holds significant sway in evaluating judicial nominees and shaping legal industry standards, but recent DOJ and conservative backlash reflects increasing political division over its role.
