A transgender immigrant, Nicol Alexandra Contreras-Suarez, pleaded guilty to second-degree rape for sexually assaulting a 14-year-old boy in a New York City bodega in February 2025. Contreras-Suarez, a 31-year-old biological male originally from Colombia, faces sentencing on April 27 in Manhattan Supreme Court and is expected to receive credit for time served, potentially avoiding additional jail time.
Prosecutors charged Contreras-Suarez initially with first-degree rape of a child under 17 and stalking. The plea deal was reached in coordination with the teenage victim’s family to prevent the victim from testifying at a grand jury or trial. The assault occurred near Thomas Jefferson Park in East Harlem, where the victim sought help immediately after the attack.
At the time of the New York arrest, Contreras-Suarez was reportedly facing charges related to prostitution, robbery, and weapons in Massachusetts. Local sanctuary policies had previously resulted in release despite those charges, according to the Department of Homeland Security (DHS).
Contreras-Suarez was also arrested by U.S. Customs and Border Protection in March 2023 for illegal border crossing in San Ysidro, California. An immigration detainer was lodged by ICE after the Manhattan arrest.
A spokesperson for the Manhattan District Attorney’s Office stated they expect federal immigration officials to detain and deport Contreras-Suarez following sentencing due to the felony conviction. DHS and ICE have highlighted the case in the context of immigration enforcement challenges related to sanctuary policies.
