Autonomous AI agents—systems that independently carry out complex tasks with minimal human control—are becoming widespread in software development, business operations, and personal automation. However, a new analysis reveals that the European Union’s AI Act, the most comprehensive AI regulation to date, inadequately addresses the unique risks these agents introduce.
Five Major Governance Challenges Uncovered
The EU AI Act was drafted before the rise of highly capable autonomous agents, leaving critical gaps in its regulatory framework. The analysis identifies five key areas where the Act falls short:
Performance: The Act’s metrics for AI system accuracy do not suit agentic tasks, which often involve balancing competing objectives without a single correct output. Equity: Agents may disproportionately advantage well-resourced users and are prone to perpetuating bias across autonomous, ongoing decisions. The Act’s main equity tool—the Fundamental Rights Impact Assessment—excludes significant high-risk uses and is designed as a periodic check, inadequate for agents requiring continuous monitoring.
Oversight: The Act assumes agent actions can be understood, stopped, or reversed, which may be impractical for high-speed agents acting autonomously in real-world environments. The “stop button” mandate oversimplifies technical challenges, and oversight focuses more on human vigilance than on necessary technical controls like anomaly detection.
Calls for Updated Standards and Guidance
To address these limitations, the analysis urges the European Commission to explicitly incorporate agent-specific considerations into the upcoming harmonized technical standards for high-risk AI systems, expected by late 2026. Priority areas include defining human oversight mechanisms for autonomous agents, establishing data management protocols for continuous data use, and adjusting performance metrics to fit open-ended agent tasks.
Additionally, the EU’s AI Office could provide crucial guidance for providers of general-purpose AI models facing systemic risks. This includes clarifying risk assessment responsibilities for models used in agents, developing mitigation frameworks for loss-of-control scenarios, and defining how to handle risks emerging from interactions among multiple agents.
